Lake Mead aquatic-science research documents substantial improvements in ecosystem

Jan. 30, 2013 ? Lake Mead National Recreation Area's water quality is good, the sport fish populations are sufficient, and the lakes provide important habitat for an increasing number of birds. This positive trend is documented in a new report published January 30 that leads to a better understanding of the natural resources of Lake Mead and Lake Mohave, and the issues that may affect natural resource management of Lake Mead NRA.

"While the Lake Mead ecosystem is generally healthy and robust, the minor problems documented in the report are all being addressed by the appropriate agencies, and are showing substantial improvement since the mid 1990's," said U.S. Geological Survey hydrologist, Michael Rosen, the lead scientist for the report. "This is thanks to proactive enhancements to wastewater treatment facilities for the Las Vegas Metropolitan area, the installation of wetlands in Las Vegas Wash, and the treatment of legacy pollutants from industrial areas near Las Vegas Wash."

Lake Mead provides significant benefits that have contributed to the modern development of the southwestern United States. The lake provides important aquatic habitat for a wide variety of wildlife including endangered species, and a diversity of world-class water-based recreational opportunities for more than 8 million visitors annually. It supplies critical storage of water supplies for more than 25 million people in three western states (California, Arizona, and Nevada). Storage within Lake Mead supplies drinking water and provides for the generation of hydropower to deliver electricity for major cities including Las Vegas, Phoenix, Los Angeles, Tucson, and San Diego. It also provides water for irrigation of more than 2.5 million acres (almost 4000 square miles or more than twice the size of the state of Delaware) of croplands.

Major findings detailed in the report include the following:

  • Basic water-quality parameters are within good ranges of Nevada and Arizona standards and EPA lake criteria. Potential problems with nutrient balance, algae, and dissolved oxygen can occur at times and in some areas of Lake Mead. The Lake Mead-wide scope of monitoring provides a solid baseline to characterize water quality now and in the future.
  • Legacy contaminants are declining due to regulations and mitigation efforts in Las Vegas Wash. Emerging contaminants, including endocrine disrupting compounds, are present in low concentrations. While emerging contaminants, such as pharmaceuticals, personal care products, or plasticizers have been documented to cause a number of health effects to individual fish, they are not seen at concentrations currently known to pose a threat to human health. In comparison to other reservoirs studied by the U.S. Environmental Protection Agency, Lake Mead is well within the highest or 'good' category for recreation and aquatic health.
  • Lake Mead and Lake Mohave continue to provide habitat conditions that support a rich diversity of species within the water, along shorelines, and in adjacent drainage areas, including organisms that are both native and non-native to the Colorado River drainage.
  • Sport fish populations appear stable and have reached a balance with reservoir operations over the past 20 years and are sufficient to support important recreational fishing opportunities. Native fish populations within Lake Mohave are declining, but the small native fish populations in Lake Mead are, stable without any artificial replenishment.
  • Lake Mead and Lake Mohave provide important migration and wintering habitat for birds. Trends include increasing numbers of wintering bald eaglesand nesting peregrine falcons. Lake Mead water-level fluctuations have produced a variety of shorebird habitats, but songbird habitats are limited. Although some contaminants have been documented in birds and eggs in Las Vegas Wash, mitigation efforts are making a positive change.
  • Invasive quagga mussels have become the dominant lake-bottom organism and are a significant threat to the ecosystems of Lake Mead and Lake Mohave because they have potential to alter water quality and food-web dynamics. Although they increase water clarity, they can degrade recreational settings.
  • Climate models developed for the Colorado River watershed indicate a high probability for longer periods of reduced snowpack and therefore water availability for the Lake Mead in the future. Federal, state and local agencies, and individuals and organizations interested the future of the water supply and demand imbalance are working together to examine strategies to mitigate future conditions.

The report was prepared cooperatively by the U.S. Geological Survey, National Park Service, U.S. Fish and Wildlife Service, Bureau of Reclamation, Nevada Department of Wildlife, Southern Nevada Water Authority, BIO-WEST, University of Nevada, Reno, and University of Nevada, Las Vegas.

Fear, threats and bad food: life aboard a sanctions-hit Iranian ship

CHENNAI, India (Reuters) - The eight Indian crew members on board the MV Amina had no inkling they were trapped on the frontline of the West's economic war against Iran.

All experienced seamen, they joined the Iranian-flagged cargo ship last year. Within months, they were caught up in a fight to prevent the ship fleeing to international waters to escape port arrest in Sri Lanka. Having disobeyed the captain's orders to weigh anchor, their courage turned to fear.

"The captain taunted us that if you fall in the water I will give a report that says that you tried to commit suicide," said 42-year-old Jesuraj, a foreman of the ship, speaking to Reuters after he and the others eventually made their way home.

"We had a lifeboat on standby and were ready to escape if required. We slept with our life jackets with the hope that if the ship did leave for Iran we would jump off and try to get the attention of some fishing boat."

For a few miserable weeks, this was life on the sharp edge of a sanctions regime that has battered the Iranian economy and squeezed the shipping fleet it relies on for commerce, cutting off funds that the West says could be ploughed into expensive nuclear arms programmes.

The Indians left the ship after authorities intervened, returned their confiscated passports and took them ashore in Sri Lanka.

Subsequently, the Amina was fired on by Sri Lanka's navy when it tried to make another getaway. A few days later, the Iranian captain took advantage of rough seas to flee, bringing the ship into Iran's Bandar Abbas port last week.

"We weren't able to sleep at night," said Harpreet Singh Sahota, 25, who worked as a helmsman on the Amina. "We felt paranoid and threatened all the time. We were desperate to get off the ship," he said in an interview in the Indian city of Mumbai.

The Amina was one of four ships ordered taken over by Germany's DVB Bank for defaulting on a loan, all of them dry bulk carriers mainly used for Iran's food grain imports.

Two of the other ships ordered re-possessed by DVB are anchored off Iran, while the fourth has been held in the northern Chinese port of Qinhuangdao. It is unlikely any can sail in international waters in the near future without threat of arrest.

According to court documents seen by Reuters in Singapore, Islamic Republic of Iran Shipping Lines (IRISL), Iran's biggest cargo carrier, owes DVB Bank more than $50 million after it halted monthly loan repayments for the four panamax dry bulk carriers in October 2011.

Revenues of IRISL and other Iranian ship operators are being squeezed by the effects of the sanctions, which include an EU ban on some maritime insurance; the exit from Iran of firms that certify ships, which is vital to ports; and the de-flagging of vessels from international registries.

BAD FOOD, NEW NAME

All this was unknown at the time to the Indian crew members aboard the Amina, although they said salaries were always paid 2-3 months late. A crew of Filipinos who preceded the Indians had already had a standoff with the captain over wage payments.

The Indians said the food was also the worst they'd ever eaten aboard a ship, and there was not enough of it.

When anchored off Sri Lanka, meat and eggs were rationed out, said Anand Nalla, a 39-year-old engineer from India's southern state of Andhra Pradesh.

"Even the Iranian crew didn't like the food and they prayed that they reach Iran safely without dying of hunger along the way," he said.

The eight Indians came aboard the ship at Luhua Shan, the Chinese island port near Shanghai, from early to late 2012, joining 16 Iranian crew members.

At first, everything seemed normal.

But the new crew came to learn that the ship had been waiting for months to get new cargo. Many foreign companies have severed ties to Iranian shipping, scared that they could lose contracts with American businesses if they help Tehran get around the sanctions.

The ship changed its name in October, when the ship was anchored at Luhua Shan. Jesuraj, who for this story only wanted to reveal his first name, was given the task of erasing the ship's previous name, "MV Shere", and painting over in yellow "MV Amina" on the black-and-red coloured ship.

IRISL has tried to dodge sanctions by changing its flags and setting up front companies, the U.S. Treasury and the EU have said.

Still unable to secure any cargo, the Amina's owners ordered the captain to leave China and on November 18, it set sail for Iran via the Indian Ocean with its hold empty.

The ship stopped off the Sri Lankan coast in early December to wait for Iranian soldiers to join it from another cargo ship. The soldiers were needed to give protection to the vessel before it ventured into the Arabian sea, where Somali pirates lurk to capture cargo ships and hold crews hostage.

The ship waited for the soldiers 11.3 nautical miles off the port of Galle.

But on the morning of December 14, instead of a boat carrying Iranian soldiers, the crew members on duty spotted a large Sri Lankan navy ship speeding towards them. On it were officials of the Colombo High Court, who boarded the ship to announce its arrest and stuck two notices on the boat. They were acting on a court order obtained by DVB Bank for unpaid loans.

"The notice said that the ship, which was mortgaged to a German bank, was arrested because of a default," said Nalla. "It also said that the ship would be sold in two weeks if the payment wasn't made,"

The Sri Lankan authorities confiscated the crewmen's' passports and service documents, a fact that, according to Sahota, the captain initially tried to conceal from the Indians.

That is when the Indians panicked. They were worried that the Iranians would attempt to break the arrest and escape home, and they were scared that, once in Iran, they could face arrest or worse for disobeying their captain's orders.

ESCAPE

One evening after the ship's arrest, the captain asked the Iranian crew members to try the engine, a normal check ahead of setting sail, which unnerved the Indians.

Ignoring the Indians' protests, the captain then gave orders to weigh anchor. But the eight Indians rushed to prevent the 16 Iranians from doing so and threatened to drop the second anchor if the captain tried to move into international waters.

Soon after the ship was arrested, Jesuraj's blood pressure started rising and he developed chest pains. But the captain refused to let him go ashore to get medical help, he said.

Amid simmering tensions, the Indians made frantic calls from their mobile phones to friends and relatives, asking them to get the Indian government to intervene.

"It was like hell and we were tense all the time," said Nalla, who said he always moved around the ship with two fellow Indian sailors for protection.

Eventually, after the Times of India newspaper and TV news channels aired their phone conversations pleading for help, the Indian embassy in Sri Lanka contacted them. Their passports were released, and pressure was put on the captain to let them go.

Not long after they had left, the Sri Lankan navy fired warning shots to prevent the Amina from leaving, but a week later the Iranians tried again and the ship headed out to sea.

The Amina subsequently vanished from tracking systems off India's southwest coast. But then, last Friday, tracking data showed that it had arrived back in Bandar Abbas, dropping anchor near two of the other ships that DVB Bank has tried to seize.

Markets higher on good news from Europe, Japan

AMSTERDAM (AP) ? Positive economic news from the European Central Bank and Germany, combined with promises of more monetary easing in Japan, helped stock indexes in those countries lead most markets around the world higher Friday.

U.S. stocks rose in early trading, helped by a strong quarterly earnings report from Procter & Gamble.

In Japan, stocks were galvanized by a further drop in the value of the yen, which is expected to help big exporters like Sony. The Nikkei index surged 2.9 percent to 10,926.67, its highest close since April 30, 2010.

The European Central Bank announced Friday that banks were expected to pay back emergency loans at a faster-than-expected clip, implying that the outlook is improving or the likelihood of disaster scenarios is receding. At the World Economic Forum in Davos, Switzerland, ECB President Mario Draghi repeated the continent's economy appears to be stabilizing and he expects recovery later this year.

Meanwhile, in Germany, business sentiment as measured by the Ifo index rose to its highest level since June, as executives said order backlogs are rising.

The Ifo report "nicely illustrates the green shoots in the German economy," said ING senior economist Carsten Brzeski in Brussels.

"Even if the current harsh winter weather might delay the blossoming somewhat, growth should return, leaving the contraction of the fourth quarter quickly behind."

Germany's DAX ended Friday 1.42 percent higher at 7,857 points, the strongest performer in Europe. France's CAC-40 was up 0.7 percent to 3,778.

Britain's FTSE 100 rose 0.3 percent, to 6,284, after official figures showed the U.K. economy contracted 0.3 percent in the fourth quarter. The drop was worse than expected and shows the economy is struggling to make any lasting recovery.

Meanwhile, Wall Street booked early gains as Procter & Gamble said its quarterly profit doubled in the October-December period and it raised its 2013 forecasts.

The Dow Jones industrial index was 0.37 percent higher at 13,875, while the broader S&P 500 gained 0.34 percent to 1,499.8.

The weaker yen is bad for U.S. exporters, but the effect of that was offset somewhat by a rise in the euro, which was up 0.65 percent to $1.3466.

The yen's drop was unambiguously bad for other Asian economies, as their own goods lose appeal to U.S. consumers.

South Korea's Kospi fell 1 percent to 1,943.97. Hong Kong's Hang Seng lost 0.1 percent to 23,580.43.

In mainland China, the Shanghai Composite Index fell 0.5 percent to 2,291.30 and the smaller Shenzhen Composite Index lost 0.2 percent at 909.52.

In Australia, the outlier, the S&P/ASX 200 rose 0.5 percent to 4,835.20.

Benchmark oil for March delivery gave back earlier gains to be 9 cents lower at $96.87 per barrel in electronic trading on the New York Mercantile Exchange.

Ireland in uproar over call for 'drink-driving permits'

Permits allowing people to drink alcohol then drive should be issued to make it easier for those in isolated, rural areas to visit the pub, according to a motion passed by a local government in Ireland.

Kerry County Council, which governs an area with a population of more than 120,000, is to formally ask the Irish government to allow some drivers to have the equivalent of up to three pints of beer.

The motion -- passed by five votes to three with seven abstentions ?-- said this would ?greatly benefit people living alone looking at four walls and restore some bit of social activity in local pubs and may also help prevent depression and suicide.?

The idea has been condemned by leading politicians, including Ireland's Transport Minister Leo Varadkar, so it appears unlikely to be adopted. Kerry does not have the power to change the law itself, the country's justice department stressed.

However, Danny Healy-Rae, the councilor behind the motion, was sticking to his guns Thursday.

Healy-Rae, who runs a pub in the village of Kilgarvan, said because people couldn?t drink alcohol in pubs then drive home, they were instead buying it in supermarkets and drinking at home. This could lead to a downward spiral that ended with some taking their own lives, he argued.

?I know of instances where the local garda [police] have to call out to these people to see if they are all right, to see if they are still there,? he said.

'Wouldn't harm or hurt anyone'
Healy-Rae said that under his plan the permits would be issued only to people in isolated rural areas who use narrow country roads where it is difficult to travel faster than 25 or 30 mph. Police would decide who was eligible to drink the equivalent of two or three pints of Guiness and then drive.

?You have to travel the roads and travel the terrain to understand -- honestly what I?m suggesting ? it wouldn?t harm or hurt anyone,? he said.

"It would allow these people to meet with their friends and neighbors and to discuss the topics of the day, the price of cattle and whatever,? he said.

The mayor of Kerry, Terry O?Brien, was among the three councilors who voted against the idea.

Asked why, he said ?because it?s absolute lunacy to allow anybody behind the wheel of a car with a drink in them.?

?We?ve come a long way from those days,? he added.

O?Brien said wearily he had been ?on the phone for the last two days explaining that.?

Varadkar admitted rural isolation was a problem, but added ?the solution to it is not to hand out drink-driving permits. Obviously it's something we very much disagree with," according to the Irish Independent newspaper.

"Most of the accidents that are happening are happening in rural areas and on country roads," he added.

The number of people who died on Irish roads is?at a record low, with 161 people killed in 2012, down from 186 in 2011.

Varadkar's comments prompted a fighting response from Healy-Rae, who said Varadkar was refusing to help ease the plight of people who were ?greatly suffering from rural isolation.?

?He?ll be judged accordingly by those people in the upcoming election,? the councilor said.

?We?ll have to keep the fight on because I?ve got massive support right around the country and from different countries around the world,? he added.

Kitchens I Have Loved

It is 10 degrees in my part of New York state today, so "warm and cozy" is definitely on my mind. ?For years I have saved two magazines showing the same house, seemingly the the very definition of warm and cozy. ?After scanning all the images of this house for you, I googled the owners' name and found the family living in an Ojai, California home in 2004, so I added these images also. ?Come join me as we view both homes and their locations, and decide if both homes have warm and cozy elements.

Don't let the July, 1993?date delude you; the home exudes warm and coziness when readers would think the issue would be full of only "beachiness".

Everybody Dies - NYTimes.com

Sitting in a snug booth at the local diner this past weekend, my younger daughter opted, while waiting for her sunny-side-up eggs to arrive and spooning the whipped cream from her hot chocolate into her mouth, to explore death.

?Your daddy?s dead?? she asked my husband, whose father died several years ago. My husband confirmed it: yes, his father is dead.

That wasn?t enough, of course. Did my husband know his daddy? Did he play with him? Live with him? Did he watch his daddy die?

Yes, yes, yes, and no. ?Why,? demanded our youngest son scornfully of his sister, ?why would you want to watch someone die??

?Well,? I ventured, ?you might ? I mean, if they were really old and ready and sick and ??

Fortunately, at that moment our food came. Because I?m not really sure where I was going with that. (And my husband?s father was none of those things.) But as Tim Kreider wrote for the Opinionator in his essay ?You Are Going to Die,? there are many, many reasons why I was right (if unsure how we were going to discuss it over eggs). Segregating the old and the ill ? segregating death ? ?enables a fantasy, as baseless as the fantasy of capitalism?s endless expansion, of youth and health as eternal, in which old age can seem to be an inexplicably bad lifestyle choice, like eating junk food or buying a minivan, that you can avoid if you?re well-educated or hip enough.?

My own father died at home, in what was once my childhood bedroom. He was, in this respect at least, a lucky man. Almost everyone dies in a hospital now, even though absolutely nobody wants to, because by the time we?re dying all the decisions have been taken out of our hands by the well, and the well are without mercy. Of course we hospitalize the sick and the old for some good reasons (better care, pain relief), but I think we also segregate the elderly from the rest of society because we?re afraid of them, as if age might be contagious. Which, it turns out, it is.

We are all, indeed, going to die. We rarely want to talk about it at breakfast, though, but maybe breakfast is the exact right time to talk about death, rather than in some after-school special kind of moment, perhaps accompanied by a specially selected picture book. We are all going to die and no one likes it but that?s the way it is, so savor those eggs.

I have no particular advice about talking to children about death, and no stories of the right way to watch a loved one die to share here (and I?m very happy that it should be so). My colleague, Catherine Saint Louis, has written about the ways children are increasingly involved in the grieving process when a family member dies in ?Letting Children Share in Grief.? It may be that when the conversation about death forces itself upon us, we are better at it (as a society) than we once were. But I read ?We Are All Going to Die,? and I thought about our conversation in the diner, and I thought, we ought to be more matter-of-fact about that, more often.

As we got up and left the table, leaving the debris of breakfast and colored, cocoa-covered paper place mats behind for someone else to clear up, a child?s voice drifted up from the table behind us. ?So,? it demanded, ?daddy?s mommy is dead, right??

Clearly the conversation itself is contagious. How do you talk with your children about death, and how have you helped them to have a better experience of inevitable grief?

Obama: Privilege to use King's Bible in inaugural

President Barack Obama says it was a privilege to take the oath of office using a Bible that had been owned by the Rev. Martin Luther King Jr.

Obama paused by a statue of King in the Capitol Rotunda after a luncheon hosted by members of Congress. He was accompanied by his wife, Michelle, and Vice President Joe Biden and his wife, Jill.

"You know this is the first time I have seen this," he said.

The King bust ? a bronze sculpture 36 inches high on a 66-inch high Belgian black marble base ? has been in the Capitol Rotunda since 1986, according to the Architect of the Capitol.

King's Bible was one of two Obama used for the ceremonial inauguration.

"I had the great privilege that the Bible we used was his Bible and they asked for it to be inscribed," Obama said. The other Bible belonged to President Abraham Lincoln.

Monday was the federal celebration of King's birthday.

Michael Bisping?s title shot hopes evaporate as Vitor Belfort wins UFC on FX main event by TKO

Michael Bisping needed a win at UFC on FX 7 in Sao Paolo, Brazil, on Saturday night to keep his title shot hopes alive. But Vitor Belfort got the better of him, winning with a second round TKO.

Belfort ended the first round well, wobbling Bisping with a head kick followed by aggressive punches and knees. The round ended before Belfort could put Bisping in real danger, but it was a sign of things to come.

In the second round, Belfort landed another head kick, but this one sent Bisping to the ground. Belfort followed with several strikes on the ground until the fight was stopped at 1:27 in the second round.

Bisping, who got into a heated exchange with Belfort during a pre-fight press conference, was humble in defeat.

"It was a beautiful kick. He caught me. He was better than me tonight," he said after the fight.

Bisping was hoping for a big win so that he could get a chance at Anderson Silva and the UFC middleweight belt. In his Yahoo! Sports pre-fight blog, Bisping said his motivation for wanting to fight Belfort was simple.

"He?s trying to take my title shot off me. He?s trying to take my family?s security off me," Bisping wrote.

But now it's unlikely he'll get near a title shot any time soon. Bisping is 1-2 in his last three fights. Though he's been in the UFC since 2006, this fight was his best chance of earning a shot at the title.

Belfort fought for the middleweight title in 2011 and light heavyweight title in 2012. He lost both times, but didn't hesitate to ask for a title shot in his post-fight interview.

"I want that belt. Get that punk Chael Sonnen out. Let me fight Jon Jones! Not that clown!"

Sonnen, who has fought at light heavyweight in the UFC since 2005, is fighting for the UFC light heavyweight belt against champion Jones in April.

Dolloway, Gonzaga, Nurmagomedov notch wins

C.B. Dolloway took a thrilling win in the co-main event over Daniel Sarafian, who was making his UFC debut. The judges saw it 29-28, 28-29, 29-28 for Dolloway, who came back to win the fight after not having a great start. Sarafian easily took the first round. He slowed Dolloway down early in the round, and got the better of exchanges throughout.

Sarafian owned the second round with big punches, but almost lost late in the round. Dolloway hit Sarafian with an uppercut, and then swarmed with several more strikes on the ground. The horn to sound the end of the round saved Sarafian from a stoppage that looked seconds away.

Dolloway started out the third round well with takedowns and much better positioning, but Sarafian swept to get on late. Sarafian took Dolloway's back, but couldn't get in a rear naked choke. Then Dolloway reversed position as the fight ended. His record moves to 13-4.

Gabriel Gonzaga's condition deep into a fight is often a problem, but he didn't have to worry about it with a second-round submission win over Ben Rothwell. After outstriking and outwrestling Rothwell in the first, Gonzaga grabbed an arm-in guillotine from the standing position. To get more leverage, Gonzaga jumped guard. He cinched Rothwell with his legs and tightened the guillotine. Rothwell tapped at 1:01 in the second round.

This is the second straight win for Gonzaga since returning to the UFC. Both have come by submission.

Khabib Nurmagomedov started the main card off with a quick and exciting win over Thiago Tavares. Nurmagomedov dropped Tavares with an uppercut, and then finished with several elbows. The fight was stopped at 1:55 in the first round, though not quickly enough for UFC president Dana White, who tweeted, "Ok that is officially the END of Dan M!!!! Guys head is straight up his [expletive] 2 night!!!! 17 vicious strikes!!!! After he was already hurt"

With this win, Nurmagomedov has three straight wins in the UFC, and an overall record of 19-0.

Obama's second inaugural is a political speech

WASHINGTON (AP) ? President Barack Obama never mentioned the words Democrat or Republican, yet his second inaugural address was a decidedly political speech.

The president was careful not to make his remarks overtly partisan, but he had a message for Republicans: Compromise and embrace government as part of the solution.

Obama, emboldened by his re-election with ultimately comfortable margins, laid out a progressive agenda. He stood up for spending on entitlement programs, promoted immigration reform, gay marriage, tax reform and laws to make voting easier, and unexpectedly gave one of his most impassioned calls for climate change ? an issue that has not been at the forefront of the political debate.

"The president may have spent more time discussing climate change in this speech than his entire first term in office," said University of Michigan debate director Aaron Kall. He described the address as "certainly a bolder and riskier speech from a president that doesn't have to run for re-election again."

The president promoted his health care reform and stood up for commitments to Medicare, Medicaid and Social Security at a time when some Republicans say entitlement programs need to be scaled back to reduce the deficit. "They do not make us a nation of takers," Obama said. "They free us to take the risks that make this country great."

This was the language of his re-election campaign and an implicit reminder of Mitt Romney's ill-timed declaration that Obama's support came from the 47 percent of American voters "who are dependent upon government, who believe that they are victims, who believe the government has a responsibility to care for them."

St. Johns University political scientist Diane Heith said she was surprised how much the campaign influenced Obama's speech.

"This is a continued effort to contrast with the Republican view that government produces dependency rather than Obama's view of a community taking care of itself," Heith said. "And some will likely think it was also a bit of a shot at the Republican ? Romney ? who put that belief out there so baldly."

Obama referenced the 1969 Stonewall riots against police harassment by patrons of a New York City gay bar, classing them as a civil rights watershed along with key moments in the struggles for women and blacks. The president said that the truth that all are created equal guides us today "just as it guided our forebears through Seneca Falls, and Selma, and Stonewall."

"Our journey is not complete until our gay brothers and sisters are treated like anyone else under the law," the president said to applause from the crowd down the National Mall, "for if we are truly created equal, then surely the love we commit to one another must be equal as well." It was a line that would never have been uttered in an inaugural address before ? not even in Obama's first, since he changed his position to become the first president to support gay marriage just last year.

There was just a passing reference to the school shooting in Connecticut that hangs over a looming debate on gun control. "Our journey is not complete until all our children, from the streets of Detroit to the hills of Appalachia, to the quiet lanes of Newtown, know that they are cared for and cherished and always safe from harm," Obama said.

Obama said Americans have never succumbed to the fiction that government is the total solution. "But we have always understood that when times change, so must we; that fidelity to our founding principles requires new responses to new challenges; that preserving our individual freedoms ultimately requires collective action," the president argued.

While there, he met with regulators, declared that China would become Apple's biggest market, and talked shop with the nation's No. 1 mobile carrier, China Mobile. Dotcom says new site legal, no revenge for Megaupload saga ...

AUCKLAND, New Zealand - Kim Dotcom, founder of outlawed file-sharing website Megaupload, said his new "cyberlocker" was not revenge on U.S. authorities who planned a raid on his home, closed Megaupload and charged him with online piracy for which he faces jail if found guilty.

?

Dotcom said his new offering, Mega.co.nz, which will launch on Sunday even as he and three colleagues await extradition from New Zealand to the United States, complied with the law and warned that attempts to take it down would be futile.

?

"This is not some kind of finger to the U.S. government or to Hollywood," Dotcom told Reuters at his sprawling estate in the bucolic hills of Coatesville, just outside Auckland, New Zealand, a country known more for sheep, rugby and the Hobbit than flamboyant tech tycoons.

?

"Legally, there's just nothing there that could be used to shut us down. This site is just as legitimate and has the right to exist as Dropbox, Boxnet and other competitors," he said, referring to other popular cloud storage services.

?

His lawyer, Ira Rothken, added that launching the site was compliant with the terms of Dotcom's bail conditions. U.S. prosecutors argue that Dotcom in a statement said he had no intention of starting a new internet business until his extradition was resolved.

?

CODES AND KEYS

?

Dotcom said Mega was a different beast to Megaupload, as the new site enables users to control exactly which users can access uploaded files, in contrast to its predecessor, which allowed users to search files, some of which contained copyrighted content allegedly without permission.

?

A sophisticated encryption system will allow users to encode their files before they upload them on to the site's servers, which Dotcom said were located in New Zealand and overseas.

?

Each file will then be issued a unique, sophisticated decryption key which only the file holder will control, allowing them to share the file as they choose.

?

As a result, the site's operators would have no access to the files, which they say would strip them from any possible liability for knowingly enabling users to distribute copyright-infringing content, which Washington says is illegal.

?

"Even if we wanted to, we can't go into your file and snoop and see what you have in there," the burly Dotcom said.

?

Dotcom said Mega would comply with orders from copyright holders to remove infringing material, which will afford it the "safe harbor" legal provision, which minimizes liability on the condition that a party acted in good faith to comply.

?

But some legal experts say it may be difficult to claim the protection if they do not know what users have stored.

?

The Motion Pictures Association of America said encrypting files alone would not protect Dotcom from liability.

?

"We'll reserve final judgment until we have a chance to analyze the new project," a spokesman told Reuters. "But given Kim Dotcom's history, count us as skeptical."

?

The German national, who also goes by Kim Schmitz, expects huge interest in its first month of operation, which would be a far cry from when Megaupload went live in 2005.

?

"I would be surprised if we had less than one million users," Dotcom said.

?

A YEAR ON

?

Mega's launch starts the next chapter of the Dotcom narrative, dotted with previous cyber crime-related arrests and whose twists and turns have been scrutinized by all facets of the entertainment industry, from film studios and record labels to internet service companies and teenage gamers.

?

The copyright infringement case, billed as the largest to date given that Megaupload in its heyday commanded around four percent of global online traffic, could set a precedent for internet liability laws and depending on its outcome, may force entertainment companies to rethink their distribution methods.

?

A year on, the extradition hearing has been delayed until August, complicated by illegal arrest warrants and the New Zealand government's admission that it had illegally spied on Dotcom, who has residency status in the country.

?

Last January, New Zealand's elite special tactics forces landed by helicopter at dawn in the grounds of Dotcom's mansion, worth roughly NZ$30 million ($25.05 million) and featuring a servants' wing, hedge maze and life-size statues of giraffes and a rhinoceros, to arrest him and his colleagues at the request of the FBI.

?

Police armed with semi-automatic weapons found Dotcom cowering alone in a panic room in the attic, while outside, a convoy of police cars and vans pulled up in the driveway. Around 70 officers took part in the raid.

?

They left with computers, files and some of Dotcom's fleet of Rolls-Royces, Mercedes and a vintage pink Cadillac tricked with personalized license plates screaming "HACKER", "EVIL", and "MAFIA".

?

"Every time you hear a helicopter, you automatically think, 'Oh, another raid', so it's something that stays with you for a long time," said Dotcom, who says he and his wife still panic when they hear sudden, loud noises in the house.

?

Dotcom was coy about the details of the launch party as builders put the finishing touches to a festival-sized concert stage in the mansion's grounds, while two helicopters circled overhead.

?

But if the impromptu, Willy Wonka-styled ice cream social he threw in Auckland earlier in the week is any indication, the party could be a more wholesome affair compared with the well-documented soirees of Dotcom's past, where nightclubs, hot tubs and scantily clad women were a common fixture.

?

"I had to grow up, you know, I was a big baby," he said. "Big baby with too much money usually leads to baby craziness.

?

"I am going to be more of a person that wants to help to make things better and help internet innovation to take off without all these restrictions by governments. That is going to be my primary goal if this business is successful." ?? Reuters

Why the NRA Said Obama's Daughters Have Armed School Guards (They Don't)

You've probably seen the new ads from the National Rifle Association?calling President Obama an "elitist hypocrite" for sending his daughters to Sidwell Friends, the Quaker school in Washington, D.C., where (the ads claim) 11 armed guards are stationed to protect students, including Obama's daughters. The ads were quickly attacked by gun-control advocates online and by elected officials from both parties. White House Press Secretary Jay Carney called them "repugnant and cowardly"; New Jersey Governor Chris Christie, a Republican, said they were "reprehensible."?

They're also completely false.?According to The Washington Post, Sidwell Friends doesn't employ any armed guards:

We spoke to parents who said they had never seen a guard on campus with a weapon. And Ellis Turner, associate head of Sidwell Friends, told us emphatically: ?Sidwell Friends security officers do not carry guns.?

So why did the NRA think otherwise? Let's look at the ads themselves. Here's a screenshot from that first television ad that started the uproar:

You can see what's going on here. An erroneous report on Breitbart.com, the conservative activist news website, led NRA officials to believe that Sidwell Friends employs armed guards. (Breitbart seems to have misread a job posting for a security officer.) The NRA even appropriated Breitbart's argument: that the existence of such guards at an elite private school reveals Obama as an out-of-touch elite, unaware of his own hypocrisy. From Breitbart reporter A.W.R. Hawkins:

Shame on President Obama for seeking more gun control and for trying to prevent the parents of other school children from doing what he has clearly done for his own. His children sit under the protection guns afford, while the children of regular Americans are sacrificed.

Hawkins adds:

If you dismiss this by saying, "Of course they have armed guards ? they get Secret Service protection," then you've missed the larger point [...] that this is standard operating procedure for [Sidwell Friends], period.

It's worth noting here that Breitbart is not an underground website, and the report the NRA ads refer to is not obscure: it currently boasts over a thousand comments, and was shared on Facebook or Twitter by over 143,000 people.

    ABU DHABI, United Arab Emirates (AP) ? With Rory McIlroy and Tiger Woods struggling, unheralded Jamie Donaldson took the spotlight at the Abu Dhabi Golf Championship on Thursday, shooting an opening-round 5-under 67 for an early one-shot lead.

    McIlroy, playing with new clubs following his multimillion dollar sponsorship deal with Nike, finished with a 3-over 75 and risks missing the cut. He repeatedly missed fairways including a shot on his 12th that hit a tree and ended up in a parking lot, leading to one of his two double bogeys. His other double bogey came when he muffed a chip in thick rough on his par-3 6th. He also putted poorly, missing a par putt on his 17th and a birdie putt on the 18th.

    Mclroy insisted his difficulties had more to do with rusty strokes than the new equipment. While he repeatedly slumped after a bad shot or frowned following a missed putt, the 2012 European Tour and U.S. PGA Tour money winner seemed resigned to the fact that it would take time for him to adjust to the new Nike clubs.

    "When you go out and you've got new stuff, you are going to be a little anxious and hopefully you play well," McIlroy said. "But I guess I can learn from it and move on and go into tomorrow and try and play a bit better. It's about playing yourself into the weekend."

    Woods, meanwhile, finished a rollercoaster round at even par after "grinding it out." The 14-time major winner had four birdies to go along with four bogeys and ended his round by three-putting his 18th for a bogey when he hit the second putt too hard.

    "I'm still right there," said Woods, who was five shots behind Donaldson. "You know, if I two-putt that last hole I'm in I think 12th or 13th or something like that. There's not a lot of guys going low out there. These fairways are tiny to begin with, but there are a lot of crosswinds."

    Woods can thank his short game and putter for salvaging the round, saving par on several occasions and sinking several long birdie putts. He made three birdies on the last four holes of his front nine. But he lost that momentum on the back nine, when he mishit a tee shot that led to a bogey on 10, and couldn't hole a short par putt on his 11th.

    "I put something up there and lost it," Woods said of his bogeys on the back. "I had another chance at 3 to make another bogey in row and made a good save there. That kind of got it going a little bit. But it was tough out there. I didn't hit it that well. On top of that, this wind just magnifies it. You really have to control your ball today."

    It was left to the 47th-ranked Donaldson to show how to overcome the wind and master the narrow fairways. He had six birdies ? including holing a bunker shot on his 12th ? to go along with a bogey. The Welshman is one shot clear of Thorbjorn Olesen of Denmark and Pablo Larrazabal of Spain. Three others including Henrik Stenson of Sweden are a further shot back in fourth.

    "Solid start, played some pretty good golf out there," said Donaldson, who was looking for his second European Tour victory. "Obviously 5 under is a great start. I played pretty good in most of the round but there were times when it wasn't quite on, we made some good up and downs. It was a matter of scoring well and keeping the momentum going."

    Microsoft bombs another security test

    For the second time in a row, Microsoft Security Essentials has failed to be certified as effective by AV-Test.org, an independent testing lab based in Germany.

    The lab publishes test results every two months, and the test from November and December 2012 looked at 25 consumer antivirus security programs. Three failed certification: PC Tools Internet Security 2012, AhnLab Internet Security 8.0, and Microsoft Security Essentials 4.1.

    This was the second test in a row in which MSE failed to earn certification. That's notable because the software is the most popular security suite in North America and the world according to Opswat. You can check the full AV-Test.org results here.

    Dave Forstrom, director of Trustworthy Computing for Microsoft, e-mailed a response to a request for comment on the test results that did not directly address the fact that Security Essentials has failed two consecutive tests.

    Microsoft believes in a defense in-depth strategy for antimalware protection that includes using Microsoft Security Essentials / Windows Defender in tandem with other appropriate security features such as SmartScreen, as well as keeping all software up-to-date. Our antimalware engine is designed to work in concert with these Microsoft security features to create a comprehensive security strategy. Microsoft focuses its protection efforts on what affects our customers, using real-world data collected from more than 600 million systems worldwide. We weigh these samples by severity and prevalence of malware in the wild.

    Microsoft missed certification by a full point on the current test, worse than the previous failure when the company missed certification by half a point. Meanwhile, AhnLab notched its third failure in the past year, although none of them were consecutive.

    PC Tool's poor showing this time around was its first in the past 12 months.

    AV-Test.org CEO Andreas Marx wrote in an e-mail announcing the results that the lab found that an average of 92 percent of the zero-day attacks were blocked. "This means one out of ten malware attacks succeeded," he wrote. He added that the products were able to clean 91 percent of the infected systems, but that "only 60 percent" could be returned to a "pre-infection state."

    While relatively few people are using AhnLabs' ineffective security suite, the same can't be said for Microsoft Security Essentials. If you are using MSE, I recommend uninstalling it and going with any other security suite. Free suites that received good ratings from CNET this past year are Avast, AVG, and Panda Cloud Antivirus.

    In the test that Microsoft just failed, Avast and AVG Free scored 14 out of 18, while Panda hit 13 out of 18. The best-scoring product was the paid license Bitdefender Internet Security 2013, which notched 16.5. Other top scores that bested the free suites came from F-Secure Internet Security 2013, Kaspersky Internet Security 2013, Norton Internet Security 2013, and Trend Micro Titanium Maximum Security 2013.

    Lakes Oil Continues Search for Shale Oil with Gippsland Basin Corehole

    Australia-listed Lakes Oil and Armour Energy disclosed Wednesday that they are drilling ahead with their Yallourn Power-1 well onshore the Gippsland Basin.

    Yallourn Power-1, sited around one mile to the north of the township of Morwell in the Latrobe Valley in PEP 166, is being drilled to further the extent of the carbonaceous source rock sequence expected to exist across much of the prolific Gippsland Basin, Lakes Oil noted in its disclosure.

    The well, which was spudded on Dec. 19, has a planned depth of 3,937 feet (1,200 meters) and is expected to take 40 days to drill. It is currently at a depth of 545 feet (166 meters).

    The company's Chairman, Robert J. Annells, confirmed with Rigzone on Wednesday that Yallourn Power-1 is targeting for shale oil in the Gippsland Basin. Annells also revealed that Lakes Oil contract rig is a mineral rig, as coring works to the well's basement is required for this project.?

    Lakes Oil secured the well during the holiday period in December last year. The company resumed drilling operations on Jan.7.

    Lakes Oil has a 75 percent interest in the well, while Armour Energy holds the remaining 25 percent stake.

    Roughly two-thirds of the Gippsland Basin is in the mainly shallow waters of the Bass Strait, with the remainder extending onshore in southeast Victoria. Australia's remaining oil resources, estimated at 1,431 million barrels, are located mostly in the Carnarvon and Gippsland basins.
